Definitions
The following terminology is included in this document:
“the Seller”: ALJAOLIVA S.L. as well as its branch offices and related undertakings, and entities which follow under any type of ownership.
“the customer”: natural or legal subject the seller contracts in order to sell the merchandise.
“the Merchandise”: Product the seller sells the client in compliance with the contract.
“the Contract”: Sales contract between the seller and client and subject to these General Sales Conditions.
“Working day”: Monday through Friday except holidays.
“Conditions”: rules which govern ALJAOLIVA S.L. sales.
Use of the website
Using and placing orders through www.aljaoliva.com implies compliance with the following conditions:
- The customer must not place any false or fraudulent order. If so, the seller is authorized to cancel and inform the pertinent legal authorities.
- The customer must provide his/her accurate and exact email, address, full name, contact phone number and ID number. Furthermore, the customer must accept the conditions so that the seller can use such personal information in case of contact when necessary (see our Privacy Policy). If personal information is not provided, the order will not be properly placed.
When placing an order through this website, the customer must be of legal age (over 18) and have the legal capacity to accept contracts as well as read and accept the terms and conditions.
Service Area
The products shown at our online store are available for sale within Spanish peninsular territory, Balearic Islands, Canary Islands and countries of the European Union. For shipping outside the EU, please contact the company through the contact form available on this web.
Placing orders
When placing an order, the customer shall proceed as follows: select a product and calculate the shipping and delivery costs. Once the purchase has been made, the customer must introduce his/her personal information and select a method of payment. Once the process is finished, a confirmation email will be sent.
Problem solving
If a confirmation email is not received or the customer has made a mistake when introducing personal information or data – problem which may lead to failure of delivery of the merchandise – the customer may contact the seller at 955707669 or send an email to tiendaonline@aljaoliva.com
Stock and availability
Our sales are subject to product availability. If there is a problem when providing the product or lack of stock once the order has been paid for, the customer will be reimbursed the full amount.
Shipping and Delivery
The merchandise will be delivered within a maximum of 20 days from the time the customer receives the confirmation email. If for any reason the seller fails to deliver the products within such deadline, the customer will be informed about any possible problem and will be able to choose whether or not to proceed with the order or cancel it and receive a full reimbursement.
In accordance with these terms and conditions, the seller will consider the shopping process as finalized when the customer or a third party – always authorized by the customer – signs the delivery slip with the shipping company.
If delivery of the products is not possible on a first attempt, a second attempt will be made on subsequent days. If delivery on this second attempt is also not possible, the shipping company will provide the customer with the option of picking up the order at one of its offices.
Prices and methods of payment
All the prices at aljaoliva.com include VAT taxes. Shipping costs are also included in final price.
The prices of the merchandise are subject to change at any time, but such changes will not affect the customers who have received a confirmation email.
In AljaOliva the customer has different payment methods: credit or debit card, PayPal or cash on delivery. When selecting PayPal as the method of payment, the order will have an additional charge of 2.9% of the total plus a fee of 0.35€. The customer must pay these fees due to the low profit made. If cash on delivery is chosen, the customer will have to pay an extra fee of 2€ in cash to the delivery company except for those customers whose places of residence are in the following areas for which this method of payment is free: Sevilla, Dos Hermanas, Alcalá de Guadaira, Viso del Alcor, Mairena del Alcor, Montequinto, San José de la Rinconada, La Rinconada, La Algaba, Brenes, Los Rosales, Cantillana, Alcalá del Río, Utrera, Albaida del Aljarafe, Almensilla, Aznalcázar, Benacazón, Bormujos, Bollullos de la Mitación, Camas, Castilleja de la Cuesta, Castilleja de Guzmán, Carrión de los Céspedes, Coria del Río, Espartinas, Gelves, Gines, Huévar, Mairena del Aljarafe, Olivares, Palomares, Puebla del Río, Pilas, Salteras, Santiponce, San Juan de Aznalfarache, Sanlúcar la Mayor, Tomares, Umbrete, Valencina de la Concepción y Villanueva del Ariscal.
When the customer clicks on the payment button, he/she confirms that the credit card is his/her. Credit cards are subject to checks and authorizations by entities responsible for them, so that if the corresponding entity does not authorize the payment, the seller will not be responsible for any possible delay in the order or failure to deliver the merchandise and the contract will be automatically canceled.
Returns and cancelations
If the customer is not satisfied with the merchandise once it has been delivered, he/she may contact the seller through the online forms specified above. The return deadline is 14 working days from the time the merchandise is delivered to the customer. The merchandise must be in perfect condition, in its original packaging and the accessories must be included in the package when applicable. Aljaoliva reserves the right to check the returned merchandise and its condition in order to proceed to a reimbursement if applicable. For payments made with a credit card, the customer must provide a bank account holder certificate and send it to tiendaonline@aljaoliva.com
The right to cancel the contract will not imply any additional fee for the customer except for those related to shipping costs when returning the merchandise back to Aljaoliva. In case of return, the address is: Carretera Bormujos-Bollullos de la Mitación, Km 9, dirección Urbanización Entrecaminos, 41110, Bollullos de la Mitación, Sevilla.
The cost of return will be charged to the customer as specified in the general Law for the Protection of Consumers and Users. In order to exercise the right of cancelation of contract, the customer must send an email to tiendaonline@aljaoliva.com by declaring unmistakably his/her decision to cancel such contract within 14 working days from the time the merchandise has been delivered to the customer. The reimbursement will be made to the method of purchase chosen by the customer when placing the order.
After the 14-day deadline, the customer will not be able to return the merchandise for a full reimbursement.
Guarantees
Guarantees are not applicable to food products. An expiration date is specified in each bottle or container.
Intellectual and industrial property
The contents of this website are property of Aljaoliva S.L. Any reproduction, distribution, marketing or transformation of its images or contents, which has not been expressly authorized by its owners, constitutes an infringement of the intellectual and industrial property rights protected by law.
The delivery of the merchandise will take place at the place indicated in the contract, or subsequently agreed by the parties.
Unless otherwise stated, the merchandise designated as stock material or another similar term, is subject to availability.
The seller may make partial deliveries, issuing an invoice for each of said shipments.
The dates and times of shipment or delivery of the merchandise is approximately 1 working day.
If the non-delivery is due to causes attributable to the customer, the customer must make the agreed payments as if the delivery had occurred, for instance as it is the case of cash on delivery. The seller may proceed to the storage of the merchandise at the customer’s expense and risk, and upon request of the latter, to insure it, in both cases provided that the customer pays in advance the foreseeable storage and insurance costs.
Applicable law
These conditions will be governed or interpreted in accordance with Spanish legislation in what is not expressly established. The provider and the user agree to submit any controversy that may arise from the provision of the products or services covered by these Conditions, to the Courts and Tribunals of the user´s place of residence.
In the event that the user lives outside of Spain, the provider and the user expressly renounce any other forum, submitting to the Courts and Tribunals closest to Aljaoliva S.L.
